1 Appellant Jerry Thane Davis was tried by jury and convicted of Conspiracy to Distribute a Controlled Dangerous Substance (Cocaine) (Count I) in violation of 63 O.S. 1981 § 2-408 [63-2-408]; Distribution of a Controlled Dangerous Substance (Cocaine) (Count II) in violation of 63 O.S. 1981 § 2-401 [63-2-401]; Possession of a Controlled Dangerous Substance (Cocaine) (Count III) in violation of 63 O.S. 1981 § 2-402 [63-2-402]; and Possession of a Weapon while Committing a Felony (Count IV) in violation of 21 O.S. 1981 § 1287 [21-1287] in the District Court of Oklahoma County, County, Case No. CRF-85-5858. The Appellant was sentenced to five (5) years imprisonment and a five thousand ($5,000.00) dollar fine (Count I), five (5) years imprisonment and five thousand ($5,000.00) dollar fine, with fine suspended (Count II), two years imprisonment (Count III) to run concurrently with Counts I and II, three (3) years imprisonment (Count IV) to run concurrently with Counts I and II. From this judgment and sentence, Appellant has perfected this appeal. We affirm.
